Terms and Conditions of Sale

1. General

These Terms and Conditions apply to all orders placed with Landy Parts for Africa (“the Company”). They supersede any terms the purchaser may seek to impose. No variation of these terms will be binding unless agreed to in writing by the Company.

All product information, pricing, and availability displayed on our website are subject to change without notice. While every effort is made to ensure accuracy, errors or omissions may occur. These Terms constitute the entire agreement between the parties.

2. Products

We supply OEM, replacement, and upgrade parts suitable for Land Rover vehicles. Manufacturer part numbers are used for identification purposes only and do not imply that parts are manufactured by Land Rover unless expressly stated.

Images are for illustrative purposes only and may differ from the supplied product due to manufacturer or supplier changes.

3. Pricing

Prices are charged at the rate applicable on the date of dispatch unless otherwise agreed in writing. The Company reserves the right to correct pricing errors and to cancel or amend orders affected by such errors.

4. VAT

All prices displayed on the website prior to login are inclusive of Value Added Tax (VAT), unless stated otherwise. Prices displayed once logged in as a trade user are exclusive of Value Added Tax (VAT) unless stated otherwise. VAT will be charged in accordance with South African tax legislation where applicable.

5. Payment

Payment must be made in full prior to dispatch unless a credit account has been approved in writing. The Company reserves the right to withhold delivery until payment has been received.

Late payments may attract interest at the maximum rate permitted under South African law.

6. Delivery

Delivery dates are estimates only. The Company will not be liable for any loss or damage arising from delivery delays caused by factors beyond its control, including courier delays, customs clearance, or supplier issues.

7. International and Cross-Border Deliveries

Orders delivered outside South Africa may be subject to customs clearance, import duties, taxes, and fees imposed by the destination country. These charges are the sole responsibility of the customer.

If duties or taxes are not paid and the shipment is returned or delayed, the customer will be liable for all associated costs, including return shipping and re-delivery fees.

8. Damage or Loss in Transit

Any damage or loss must be reported in writing within 7 days of delivery. Requests to leave parcels unattended or with third parties are made at the customer’s own risk.

9. Returns and Refunds

Returns are subject to our Refund Policy, available on our website. Incorrectly ordered items may be subject to a handling or restocking fee. Electrical parts, special-order items, and used or installed parts are non-returnable unless defective.

Faulty items may be returned to suppliers for testing, which may take several weeks. Refunds or replacements are subject to supplier warranty outcomes.

10. Warranty

Where applicable, products are covered by manufacturer or supplier warranties. The Company’s liability is limited to the replacement or refund of defective goods and excludes any consequential or indirect losses.

11. Acceptance of Orders

All quotations are invitations to do business and do not constitute a binding offer. Orders are only deemed accepted once confirmed by the Company and/or dispatched.

12. Ownership

Ownership of goods remains with the Company until full payment has been received. The Company reserves the right to recover goods in the event of non-payment, where legally permissible.

13. Limitation of Liability

To the extent permitted by South African law, the Company shall not be liable for any indirect, incidental, or consequential damages arising from the use or supply of goods.

Nothing in these Terms limits any rights the customer may have under the Consumer Protection Act, 2008.

14. Governing Law

These Terms and Conditions are governed by and interpreted in accordance with the laws of the Republic of South Africa

Governing Laws and Jurisdiction

This website and all transactions concluded through it are governed by and interpreted in accordance with the laws of the Republic of South Africa, including the Electronic Communications and Transactions Act, 2002 (ECTA) and the Protection of Personal Information Act, 2013 (POPIA).

In accordance with section 22(2) and section 26(1) of ECTA, an electronic agreement is deemed to be concluded at the time and place where acceptance of an offer is received by Landy Parts for Africa. An order placed on this website constitutes an offer, and acceptance occurs upon receipt of payment and/or confirmation or dispatch of the order. No separate acknowledgement of receipt is required for the agreement to be valid.

All payments are processed using payment systems that comply with section 43(5) of ECTA and accepted technological security standards at the time of the transaction.

By using this website, you agree that the courts of the Republic of South Africa shall have exclusive jurisdiction in respect of any dispute, claim, or legal proceeding arising from or related to the use of this website or any electronic transaction concluded through it, regardless of the customer’s location.

Privacy Policy

Landy Parts for Africa is committed to protecting your personal information in accordance with the Protection of Personal Information Act (POPIA) and Section 51 of the Promotion of Access to Information Act, No. 2 of 2000 (PAIA).

1. Information We Collect

We collect personal information that is necessary to process orders and provide our services, including:

  • Name and surname
  • Contact details (email address, phone number)
  • Delivery and billing address
  • Vehicle and order-related information
  • Payment information (processed securely via third-party payment providers)

2. How We Use Your Information

Your information is used to:

  • Process and deliver orders
  • Communicate about purchases, deliveries, or queries
  • Comply with legal and regulatory requirements
  • Improve our products, services, and customer experience

3. Sharing of Information

We only share personal information with:

  • Courier and logistics partners
  • Payment service providers
  • Suppliers where required to fulfil an order

All third parties are required to protect your information and use it only for the intended purpose.

4. Cross-Border Information

As we supply parts across Africa and use cloud-based systems, your personal information may be stored or processed outside South Africa. We ensure that adequate data protection safeguards are in place in line with POPIA.

5. Security of Information

We take reasonable technical and organisational measures to protect personal information against loss, misuse, unauthorised access, or disclosure.

6. Your Rights

You have the right to:

  • Request access to the personal information we hold about you
  • Request correction or deletion of your information
  • Object to the processing of your personal information

Requests may be made in accordance with PAIA and POPIA requirements.

7. Access to Information (PAIA)

This Privacy Policy forms part of our PAIA compliance. Formal requests for access to records may be submitted in writing and will be handled in accordance with Section 51 of PAIA.

8. Updates

This policy may be updated from time to time. The latest version will always be available on our website.

Refund Policy

At Landy Parts for Africa, we take pride in supplying quality OEM, replacement, and upgrade parts. If you are not satisfied with your purchase, the following refund policy applies:

Refunds are available on unused, uninstalled items returned in their original packaging within 7 days of delivery.

Parts must be returned in resaleable condition. Electrical components, special-order items, and clearance items are non-refundable, unless defective.

Refunds will only be processed once the returned item has been inspected and approved.

Shipping and handling costs are non-refundable, and return shipping is the customer’s responsibility unless the item is faulty or supplied incorrectly.

If an item is found to be defective, we will offer a replacement or refund, subject to supplier warranty conditions.

All refunds are processed to the original payment method where possible. We recommend confirming vehicle compatibility before ordering to avoid delays or unnecessary returns.

Delivery Policy

1. Delivery Areas

Landy Parts for Africa delivers throughout South Africa and to selected destinations across the rest of Africa. Delivery availability may vary depending on location, courier coverage, and customs requirements.

2. Delivery Times

  • Delivery times are estimates only and are calculated from the date of dispatch, not the order date.
  • Orders are dispatched once payment has been received and cleared.
  • Delays may occur due to courier constraints, stock availability, public holidays, customs clearance, or circumstances beyond our control.

We will always do our best to dispatch orders as quickly as possible.

3. Delivery Charges

Delivery costs are calculated at checkout based on:

  • Destination
  • Parcel size and weight
  • Courier rates

Delivery charges are displayed before payment is completed.

4. International and Cross-Border Deliveries

Orders delivered outside South Africa may be subject to:

  • Customs inspections
  • Import duties and taxes
  • Clearance and handling fees

These charges are not included in the product price or delivery fee and remain the sole responsibility of the customer. Courier agents may contact the recipient directly to arrange payment.

Failure to pay duties or taxes may result in the order being delayed, returned, or cancelled, with all associated costs charged to the customer.

5. Address Accuracy

Customers are responsible for providing complete and accurate delivery information.

We cannot be held liable for delays, losses, or additional costs resulting from incorrect or incomplete delivery details.

6. Failed or Missed Deliveries

If delivery fails due to customer unavailability, refusal, or incorrect details, additional delivery or return fees may apply. Re-delivery will only occur once all outstanding charges have been settled.

7. Damage or Loss in Transit

All deliveries should be inspected upon receipt.

Any damage or loss must be reported to us in writing within 7 days of delivery to allow us to lodge a claim with the courier.

Requests to leave parcels unattended or with third parties are made at the customer’s own risk.

8. Collection

Where collection is offered, customers will be notified once their order is ready. Orders not collected within a reasonable time may incur storage or handling fees.

9. Risk and Ownership

Risk in the goods passes to the customer upon delivery. Ownership remains with Landy Parts for Africa until full payment has been received.

Returns Policy

At Landy Parts for Africa, we understand that sometimes parts need to be returned. The following policy outlines when and how returns are accepted.

1. Return Eligibility

Items may be returned provided that:

  • The return request is made within 7 days of delivery
  • The item is unused, uninstalled, and in original packaging
  • The item is in a resaleable condition

Proof of purchase is required for all returns.

2. Non-Returnable Items

The following items are non-returnable, unless faulty or incorrectly supplied:

  • Electrical and electronic components
  • Special-order or non-stock items.
  • Clearance or discounted items
  • Parts that have been installed, used, or damaged

3. Incorrectly Ordered Items

If a return is due to incorrect ordering by the customer:

  • Return shipping costs are the customer’s responsibility
  • Original delivery charges are non-refundable
  • A handling or restocking fee may apply

We strongly recommend confirming part compatibility before ordering.

4. Faulty or Incorrect Items

If an item is faulty or supplied incorrectly:

  • Notify us in writing within 7 days of delivery
  • The item may be returned for inspection and testing
  • Where applicable, the item will be sent to the supplier or manufacturer for assessment

If the fault is confirmed, we will offer a replacement or refund, in line with supplier warranty terms.

5. Returns Process

All returns must be authorised before being sent back.

Returned items without prior approval may be rejected or delayed.

Items must be securely packaged to prevent damage during return transit.

6. Inspection and Processing

  • Returned items are inspected upon receipt
  • Processing times may vary depending on supplier testing requirements
  • Refunds are only processed once the return has been approved

Refunds will be issued to the original payment method where possible.

7. Risk and Responsibility

The customer remains responsible for returned items until they are received by Landy Parts for Africa. We recommend using a tracked courier service.

8. Consumer Rights

Nothing in this policy limits any rights the customer may have under the Consumer Protection Act, 2008.

Cancellation Policy

At Landy Parts for Africa, we understand that orders may sometimes need to be cancelled. This policy explains when and how cancellations are accepted.

1. Order Cancellation Before Dispatch

Orders may be cancelled before dispatch, provided that:

  • The cancellation request is submitted in writing, and
  • The order has not yet been processed, packed, or handed over to a courier.

Where cancellation is approved before dispatch, a full refund will be processed, excluding any non-recoverable transaction or payment gateway fees, where applicable.

2. Orders Already Dispatched

Once an order has been dispatched, it cannot be cancelled and will be treated as a return, subject to our Returns and Refund Policies.

All delivery, return shipping, customs duties, and handling costs remain the responsibility of the customer.

3. Special-Order and Non-Stock Items

Orders for special-order, non-stock, or custom-sourced items may not be cancelled once the order has been placed with the supplier. These items are sourced specifically on request and cannot be reversed.

4. Partial Cancellations

Where an order contains multiple items, cancellation may be allowed for items that have not yet been processed or dispatched, subject to availability and supplier commitments.

5. Delays and Unavailability

If an item becomes unavailable or cannot be supplied within a reasonable timeframe, Landy Parts for Africa reserves the right to cancel the order and issue a full refund for the affected item.

6. Consumer Rights

Nothing in this policy limits any rights the customer may have under the Consumer Protection Act, 2008, including the right to cancel certain transactions within prescribed cooling-off periods where applicable.
